Beware of Gearworx.net. They shut my website down, kept my money, kept all of my files, and then laughed at me! Tell all of your friends and all of your family to stay away from this company. They don't even own their owen servers!!!!!!!!!!!!!!

i've been considering these guys for hosting. while researching, i just found this at another board. Its seems that you are full of sh*t. :eek:

the guy from Gearworx.NET just made a post today, they they've been subpoenaed by the FBI about you. you better get a lawyer...loser!!! :D

Gearworx LLC servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: Pirated software, Hackers programs or archives, Warez sites, MP3, and IRC bots. The subscriber to Gearworx LLC service agrees to indemnify and hold harmless Gearworx LLC from any claims resulting from the use of the service that damages the subscriber or any other party.

Gearworx LLC will be the sole arbiter as to what constitutes a violation of this provision.

The failure by a customer to meet or follow any of the above policies/terms is grounds for account deactivation. Gearworx LLC will be the sole arbiter as to what constitutes a violation of the AUP. Gearworx LLC reserves the right to remove any account without prior notice.

When Gearworx LLC becomes aware of an alleged violation of its AUP, Gearworx LLC will initiate an investigation. During the investigation, Gearworx LLC may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, Gearworx LLC may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Gearworx LLC will notify the appropriate law enforcement authorities of such violation.

Gearworx LLC does not issue credits for outages incurred through service disablement resulting from AUP violations.

Gearworx LLC customers agree to indemnify and hold harmless Gearworx LLC from any claims resulting from the use of our services that damages them or any other party. The Gearworx LLC service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Gearworx LLC expressly disclaims any representation or warranty that the Gearworx LLC service will be error-free, secure or uninterrupted. No oral advice or written information given by Gearworx LLC, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Gearworx LLC and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

You ought to speak with your webmaster about this. He agreed to our policies so you have no say in this matter.

Be mindful of what you say and act, we provided you the FTP access so you can grab your files. Running a smear campaign against won't solve your issues...

Apparently there was an issue with trademark/copyright violation, which meant the signed terms of service was violated... in which case they have every right to issue you warnings and/or terminate your account without notice.

Please feel free to elaborate on their refund policy, and the length of your term there. Do they offer a money-back guarantee? Their "keeping all your files" was probably in direct co-relation to termination of your account when it violated the terms of service. This is where a backup copy of the site in question comes in handy if you plan on relaunching elsewhere. Generally concerns with this are outlined in their policies when you sign up.

Feel free to elaborate on that as well. It doesn't look like they're selling dedicated servers, so they may have a contract worked out with another company or something along those lines - some companies do that and there is nothing wrong with it. However if this is a biased statement with no facts as backup, it will be totally disregarded.
